Don’t Be Afraid of the Big, Bad Credit Collection Company

By Michele Moncrieffe

Due to the state of the economy, a lot of people have found themselves dealing with one credit collection company or another. Debtors often express fear in regards to communicating with collection representatives. Working with a collection agent is the only way for the debtor to overcome their debt, but many think that the benefits of recovery are out-weighed by the indecent tactics used by collection companies.

There is a certain code of conduct that debt collection companies must adhere to when communicating with a debtor in order to obtain a recovery. These codes of conduct are mandated at both the state and federal level. Late in the 70s, the United States Government passed the Fair Debt Collection Practices Act. This act clearly outlines prohibited and required conduct by collection representatives. The totality of the act is available on the internet.

Debtors should not be afraid to communicate with collection agents. If the phone rings, and you think it’s a collections agent. Answer the call and be calm. If you do not feel comfortable answering any of the questions that the agent asks, then you can ask them to call back at another time. Before you end the call get all the information you need to do research on the collection company.

A professional collections agent will announce who they are and what company they represent within the first minute of a phone call. These agents do not want to ruin the relationship between a creditor and debtor. They simply want to help the creditor recover a debt. If an agent is rude or otherwise unprofessional, then it reflects badly on the creditor they represent as well as the collection agency that employs the agent. If a debtor interacts with an unprofessional collections agent, then they should refer to the laws for debtor rights, and decide on the best act of recourse.

Do not be afraid of working with a collection agency to exterminate your debt. The sooner you overcome a debt, the sooner you can rebuild your credit. Just remember to know your debtor rights and well as how a collection agent is obligated to handle themselves during telecommunication as well as written correspondence. Do not let anyone take advantage of you or your situation because you were not correctly informed.
