Filing a patent application can often be a difficult job. Here are some tips to ensure that your patent is not refused approval for minor reasons.

Firstly, your patent needs to meet the three pronged NUN test – novelty, utility and non-obviousness. In other words, your concept should be novel and should be capable of financial viability as well as marketability, as no administration would want to grant a patent for a useless invention. Your invention must be patentable in the sense that it should not be a minor modification of a current commercial product or have only a trivial, short term utility. In addition, it should be non-obvious to other persons in that area of thought, in the sense that others should not be able to come up with/arrive at the same idea easily.

You have to ensure that your patent application lucidly mentions all the information of your product. In some cases, you will also need to attach the related designs and basic drawings to better demonstrate your creation. This step is quite important as the exhaustive explanation of the invention helps the authorities in determining whether your invention is in any way similar to the already present products or ideas in the field or not. Not providing these details might even result in your invention being rejected right in the initial stages.

The process of getting a patent is often long winded and difficult on account of the intricate assessment that it involves. Hence, it is advised to hire a lawyer, who has been involved in intellectual property cases with a specialization in patents and has a good understanding of the subject matter. This would not only save you time and effort, but also minimize the chances of your patent application being disapproved.
