State To Collaborate With Workmen?S Compensation Division, Perhaps

The workmen’s compensation division administrator is set to seek the legislature’s establishment of a fee schedule. The fees would cover lawyers who handle workmen’s compensation cases. The administrator also wants an appeals board to be established. This division, which certainly has had its share of problems, assists people who get hurt while at work. The department head promised that changes are coming soon.

Recently, corrupt doctors and lawyers were found to be stealing funds from both injured workers and the division itself. One state senator, also a lawyer, has been sent to prison already because of this schedule. More cases will be filed by the attorney general in this issue.

A lawyer is intending to ask the platform convention to make large alterations in the workmen’s compensation operations. Claims should no longer be settled by a lone administrator, and there should be a set fee schedule for lawyers, which doesn?t rely on how much the worker is awarded, according to this lawyer.

Although one major political party recently claimed that the scandal would not be raised as a political issue, lawyers are quickly doing so and then finding fault with each other. According to one lawyer, if law makers don?t try to solve the problem and just spend time fighting, both employers and employees will suffer for it.

The legislature was reviewing proposals for a fee schedule and appeals board. Unfortunately, these were both killed in committee. Members cited a need for legislative audit of the division before they made their decisions. The audit was not completed before the legislature dismissed. Evidently, there was an agreement made to let the bills stay in committee.

The division is making the following changes, which were suggested by legal counsel. The public will be able to see all files, except personal medical files. This change came about after a leading newspaper won a suit against the department.

Those who have won their claim will be notified of the award amount. They can then look forward to receiving a check on a regular basis. One lump sum will be paid to lawyers. Workers will be told exactly how much their settlement is, and then the checks will only be in their names. The division already follows this policy.

The interim committee for the legislation is striving to figure out an appropriate premium rate structure for employers. There has also been an overhaul of the way in which the amount of compensation is decided. There is a medical committee being formed made up of three doctors who are tasked with looking into cases and deciding whether claimants injuries were work related. This committee requires a fair amount of time from the doctors on board so it is hard to find those able to spare so much time.
