What Happens If I’m Hit By An Uninsured Motorist?

People tend to believe that if a car that is uninsured causes an accident then they cannot claim against the driver, luckily this is incorrect. There is still a way for people to claim compensation but it can be more complicated than simple cases where people are claiming off an insured driver.

An organisation called the Motor Insurance Bureau (MIB for short) is set up in order to provide compensation to people who are victims of road accidents which involve an uninsured or untraceable driver. They also deal with property damages of a similar nature.

If you are a child who wishes to claim against a hit and run driver the MIB now allow you to claim up until your 21st birthday. You will not be barred from claiming after three years like the usual law states.

The MIB conduct two different schemes known as Untraced Drivers Agreement and Uninsured Drivers Agreement , it is important to always get advice from a trained personal injury lawyer regarding your claim as MIB claims can be complicated. Depending on which category your claim belongs to your solicitor will then move forward in accordance, gathering any evidence required.

Your insurance company may be able to provide help in tracing the other motorist but the outcome will be the same if they are uninsured you will need to liaise with the MIB through a competent solicitor.

Certain rules and procedures are in place which you must comply with in order to make a claim. A solicitor that is fully aware of the way in which the MIB works should be able to provide you with all the help you need. Anybody suffering from an injury caused by an uninsured driver can make a claim for compensation, the MIB will investigate your case but a specialist solicitor is essential to represent you.
