Getting Real Estate In California

There are many similarities between the California real-estate buying process and that elsewhere and in other state. There are quite a few things that are different as well. I will cover a little of both in this text.

As you might be guessing, the bulk of the things that are different in California, are due to the way the legislature likes to regulate things. One such obvious example is the fact that in California it is only legal for you to make profit off of Real Estate transactions, if you carry a license by the state.

In real terms, this difference makes it so that if you want to buy real estate in California, working through a licensed professional is no longer only smart, in this case it is mandatory. This state has so many legal loopholes and regulations, that it is impossible for you meet and know all of them, unless it is your job to follow and study them on a regular basis. That’s why all real estate in this state is done through Realtors.

How does the actual process work then? Well, you go call up a great Realtor. She decides if she can work with you (based on your finances) and then she decides what homes you should check out. If you’re ready, you can start driving around and start seeing the different homes, until you see one that you happen to like.

This is where the rubber meets the road for the Realtors. She now needs to sit down and form an offer to the seller. She will propose and make certain specific guidelines of the offer with the hope that they meet the seller’s needs. The seller (or their Realtor) responds with what is known as a counter-offer. If all checks out fine, the California laws say you need to go to an Escrow.

Specifically, the way it works in California is that Escrows are always used for all real estate transactions. It has been decided that no risk must exist between any sellers or buyers. In your case, once it goes into escrow, you will need to get some financial dealings handled with the lenders, and then your escrow gets released, and the seller officially hands you over the home.
